Terms of Service

1. General Provisions

These General Terms and Conditions govern the relationship between the user and the operator of the Tenzio application (hereinafter "Application"). The operator of the Application is Roman Padych, located at Podzávoz 423, 022 01 Čadca, Slovakia, ID: 53880048, registered in the Trade Register of the District Office Čadca, Trade Register Number: 520-32321 (hereinafter "Provider"). Information regarding the processing of personal data is provided in a separate Privacy Policy document.

2. Registration and Account

Registration is required to use the Application. The User is obliged to provide true information. Account access is password protected; the User is responsible for its security. The Provider reserves the right to cancel or restrict the User account without prior notice in case of suspected abuse or violation of these Terms.

3. Use of the Application

The Application serves for personal recording of blood pressure and heart rate values. The User agrees not to use the Application in a way that could disrupt its integrity or the security of other users data. Any attempt at copying, reverse engineering, automated data collection (scraping), or other interference with the technical structure of the Application is prohibited. Some informational content in the Application (e.g., articles, blog) may be generated or assisted by artificial intelligence (AI) technologies. This content is for informational purposes only.

4. Important Medical Disclaimer

Tenzio is NOT a medical device, diagnostic tool, or certified medical software. All outputs, analyses, and charts are for informational purposes only. The User must not change their treatment or medication dosage based on data from the Application without consulting a doctor. In case of acute difficulties, seek medical help immediately. The Application is not intended for real-time monitoring of vital signs and does not serve for the detection of acute medical conditions (e.g., heart attack, hypertensive crisis).

5. Intellectual Property

All content of the Application, including graphics, logos, and texts, is the property of the Provider and is protected by copyright law. The User only acquires a non-exclusive license to use the Application for personal use.

6. Subscription and Digital Content

Selected features are paid. Payments and billing are handled by Lemon Squeezy, acting as our authorized reseller (Merchant of Record). By activating a subscription, the User requests immediate provision of digital content. Hereby, the User acknowledges and agrees that by granting consent to start the provision of the service before the expiry of the withdrawal period, they lose the right to withdraw from the contract. Subscriptions automatically renew for the same period unless canceled in the profile or platform settings at least 24 hours before the end of the current billing period. Payments for subscriptions are non-refundable except in cases provided by law. Upon cancellation, access to paid features remains until the end of the current prepaid period.

7. Limitation of Liability

The Provider is not responsible for the accuracy of data entered by the User, nor for any health consequences associated with incorrect interpretation of information in the Application. The service is provided as is, without guarantee of continuous availability.

8. Changes to Terms

We reserve the right to change the Terms. The User will be informed about important changes by email or in the Application. Continued use after a change is considered consent to the new version.

9. Governing Law

These Terms and the legal relationship between the Provider and the User are governed by the law of the Slovak Republic.

10. Dispute Resolution

A User who is a consumer has the right to contact the Provider with a request for redress. If the Provider responds negatively or does not respond within 30 days, the consumer has the right to submit a proposal for alternative dispute resolution to an alternative dispute resolution entity (e.g., SOI or EU ODR platform).
